Abortion remains legal in Wyoming while Wyoming Supreme Court declines to answer certified questions on constitutionality of abortion bans.

The Wyoming Supreme Court has sent our case challenging the constitutionality of the abortion bans back down to the district court. It encouraged the district court to enter an order on the summary judgment motions.

This decision does NOT change the status quo – abortion remains legal in Wyoming. Wyomingites continue to be able to make their own health care decisions and retain the bodily autonomy key to their freedom and equality. We remain hopeful that Wyoming values of freedom and equality, embodied in the Wyoming Constitution, will continue to protect Wyomingites from dangerous and demeaning governmental overreach into their private decisions.

Wyoming Supreme Court rejects abortion ban constitutionality questions — for now

The Wyoming Supreme Court again declined to decide the constitutional questions Judge Owens of the Teton County District Court certified to it. Instead, it strongly encouraged Judge Owens to rule on the pending summary judgment motions. We now await Judge Owens’ ruling on those motions.

District Court Judge Owens certifies questions to the Wyoming Supreme Court

Judge Owens filed the order certifying questions we had raised about the constitutionality of the abortion bans to the Wyoming Supreme Court rather than entering an order on the parties’ motions for summary judgment. We now await the Supreme Court’s decision whether it will accept certification.
